Carobone, Ilex is Holly, just in case you needed that. :) And I agree with Dario, deffinitely holly.
 
Sorry to contradict you fellas but it looks a lot like california live oak or cal. coastal live oak. Quercus agrifolia. But I could be wrong. Maybe Paul or another Californian can give their $0.02
 
Looks like a coast live oak to me too.

My first thought was Q. agrifolia as well (Coast Live Oak), leaves look exactly like one I have. Any chance of a better picture in natural light?
 
coast live oak. not just the leaves, but the way it's ramified and the flair of the trunk tell its a coastal live oak. I have 1 or 2 in my yard, as anyone that knows me will tell you.
